Remember this report from our nation’s history?
CNN (Continental News Network) Boston, 1773: The city of Boston canceled a proposed protest over tea taxes today, citing the fear that too many people dressed as Indians would be gathered near the wharves. Organizers expressed sadness over the cancellation, but meekly returned to their homes fearful of upsetting the officers of the Crown. Taxmen breathed a sigh of relief as the tar and feathers were put away not to be used this day.
You don’t remember that pre-revolutionary history? I should say you shouldn’t, because it didn’t happen. But flash forward a few hundred years and you’ll find it is happening today in Cape Coral, Florida where city officials canceled a tax day tea party gathering because they “feel too many people could show-up.”
That’s right, folks, the God-given, long-held American right to assemble and protest the actions of our government has been canceled due to too much popularity of the protest.
And what does it come down to? Money. You see, the city officials want an insurance policy taken out so that organizers can cover any loss that might occur as a result of the rally. And those insurance policies cost hundreds of dollars.
The tea party organizers of Cape Coral, though, aren’t the only ones to find this restriction of their free speech and rights to assemble. Tea party organizers all across the country have begun to find out just how difficult, if not impossible, it is to be “allowed” to exercise their God-given right to speak their minds against government excess and criminality. City governments all across the country are charging fees for “permits,” forcing organizers to pay out huge sums for “insurance policies,” and binding tea party organizers in all sorts of government red tape.
In many instances, organizers are being told that they aren’t “allowed” to hold rallies on government property. Imagine that? We, the taxpayers of the city/state/federal government aren’t “allowed” to gather on property that our own taxes paid for.
And then there are the “permits” required to reserve the day, arrange the police protection, and clean up afterward. Often those “permits” can only be applied for at certain times a year, precluding any spontaneous assembly. Also, these “permits” can be denied with no reason stated quashing at birth any plan to exercise the right of assembly.
Here one might wonder how it is that we so often see those lefties appearing on our TV sets engaging in their many organized protests? Don’t the flotsam and jetsam of the far left seem to have large protests all the time? One might be drawn to imagine that the government is involved in some sort of grand conspiracy to allow those with anti-American sentiment, the moonbats of the left, to march with impunity. But, hold the tinfoil hats, won’t you? Because the wackjobs of anti-war ilk and the shrill, circus acts of the Code Pinkos are expected to cut through the same red tape the tea party organizers have been confronted with. The lefties are just better at it.
You see, contrary to popular conception, the far left has some deep-pocketed backers (your George Soros types, unions and even government funds) and a raft of organizations that do “protests” as a full time job. Their protest marches and rallies are far from spontaneously organized. These groups are thoroughly knowledgeable about the red tape and governmental hoops through which they must jump to carry off a successful protest assembly. After all, the hatemongers of the left are intimately intertwined with city governments all across the country. They understand what needs to be done because, by and large, city officials used to belong to, or belong still to the sorts of groups that plan lefty protests. Your new president is one of them. Being part of government, these leftie protest marchers help write the rules, being intimately associated with government they are quite well informed about what is required and how to get around or satisfy those rules.
But the obstacles are coming as a shock to the average citizens that love this country. For their whole lives peace-loving, work-a-day Americans have taken for granted that there exists the freedom to assemble completely unaware that those rights have been eliminated by stealth regulation by governments all across the land.
And now the folks in Cape Coral, Florida have learned their lesson.
Americans do not have the rights they always thought they did. There is no right to protest government. There is no right to assemble. The people have no rights at all to voice their displeasure. Shut up people. Go home. Nothing to see here. Go quietly back to your IPods and DVDs. Big daddy government will take care of you. The Obemmessiah will decide what’s best for you. Don’t worry your little heads. Oh, and thank you for your payments on April 15th.

As an Independant, I am concerned that the majority of these conversations are missing the assualt on the Constitution. These Tax Revolts should be only the start of Redressing, not the Government (we are the Government), but the Morons that are suppose to represent us. Their duties, Constitutionally, are to defend this County against foreign invasion, the sovereignty of our borders and laws and protect our rights as citizens. This is their sole job, nothing else. What I see as a major mis-step is the absence of Federalism (State Constitutions) in the conversation. The Bail-Out too AIG was a State issue not a Federal (U.S.) concern. All the Bail-Outs and issues (not that they haven’t had a negative impact on our Citizens) concerning the Economy are distractions from the real is agenda. A Global Society. Gary and many others here are right when they say “Just show up” & “Lefties aren’t afraid to commit civil dissobedience, why are you.” I am a lefty and I am on this site trying to find out dates for the protest. To be honest I already had it in my mind that I would be attending an unregistered protest. The city NEVER gives out permits for protests, only parades. All of the lefties you see on television are there illegally trying desperatly to regain their right for peacefull protest. It is a hard fought battle involving personal risk performed for the sake of something you believe in. I don’t know where you get your information from but many leftist organizations are enraged at the desasterous policies of Obama. We feel that we have been duped by yet another politician with interests and allegiance to finance and not the people. The dems and lefties you see touting the line are either hopelessly enthralled or too stubborn to admit that they are wrong. I think we will quickly see a day when the “left” and the “right” must work together to try and preserve whats left of our constitution and our government.
After Cape Coral was rescheduled, in spite of the Mayor and the media doing everything possible to stop the tea party. They put it together in 2 days and still managed to have about 300 people. I am from Fort Myers, but attended in support of the Cape Coral Residents. Also will attend the one in Fort Myers April 15th. Hats off to Cape Coral residents who showed up in spite of everything thrown against them. They have local tax issues which were also addressed. That is why the Mayor tried to stop it. He is corrupt.
Florida is just one state that said your couldn’t gather. Cities in West Va, Kentucky, Oklahoma, Nevada and Illinois had similar problems. They just kept moving thier gatherings to different venues until they got tierd of confronting the organizers. Some may try to keep us from showing up, but they will never succeede in shutting us up! We are here and we show no fear. WE THE PEOPLE!
I live in Cape Coral and I will be there. I hope to see my friends and neighbors there as well. Our rights are diminishing one by one and it is our duty to defend and secure the ones we still have before they also are taken away without cause. Please join me and stand up for your rights.
I am here in Florida-we have to have a permit for everything! Garage Sales included. Once a child got in trouble for not having a permit for a lemon aid stand (or the parents-not sure on the details). A man once got in trouble for not having a permit for building a tree fort for his kids and the list go’s on. Florida is thee most ridiculous place to live as far as permits. I will be at the Fort Myers Tea Party-that is where I live. Willing to do my part. Enough is enough!

I’m in agreement with all those who say “Just show up”. Do it. Just show up. They’ll get the message. As long as it’s peaceable, there isn’t a lot they can do. They don’t have jail space to put everyone in jail.
OK…so, I can see that we all feel the same way about a government official (who works for US, by the way) telling us that we can’t publicly assemble because “the police overtime, cleanup, liability, etc..are an issue…well, we pay for that with our tax dollars anyway, so that’s too bad…First of all, EVERYONE should show up at EVERY one of these events! They can’t arrest us all! And me for one, would be happy to be the face of a protest and let them arrest me for it, because I know that you all would come to the courthouse to observe how they would ever make those charges stick! God forbid we all get in a courtroom! I’d start booking flights TOMORROW to stand up for We The People!
Here is the solution, and I am willing to do this myself if there is enough interest in this and it could have an ENORMOUS effect on these protests in a good way for us…
I would create a website where the organizers for these protests would simply promote everyone to go to the website 1 hour before their protest is scheduled, and NOT disclose the exact location of the event until I post the exact location of the meet and the local governments won’t even see us coming…And we need to do this over, and over, and over again…If they want us to stop randomly showing up in packs of 5000+, then they need to stop their abuse of power and start listening to us! If they fix these issues that we ALL have problems with, then we would have no reason to protest now, would we?
This could gaina TON of momentum on a national scale, and with this momentum, we could promote the largest gathering of people for protest in Washington D.C. very, very soon! A million people? Please….MILLIONS OF PEOPLE converging on Washington D.C. without them having a clue where we were going to gather would scare the crap out of them, and it should…That many people could cause a revolution if they wanted to, and if the government realized that, maybe they would finally listen to us, and finally start traeting Americans fair and equal to each other!!!

After going through almost the whole permit process, we established that I didn’t need one. I don’t have to pay for anything, because it is a free speech issue. Woohoo! I immediately sent him (Jim Burch) an email. I just recieved a phone call from a detective in Cape Coral asking about my email to the Mayor (the Mayor felt threatened) I explained to him the situation, he said he completely understood and thanked me for my time.
I was shocked!!!

I don’t believe that they can take away our right to protest. It is a right not a privilege like a drivers licenses. I wonder what would happen if everyone shows up anyway. Just because you think that the Democrats are better acquainted with those rules, or have more money, to buy insurance policies, doesn’t mean it’s their fault. “Freedom Works.org, an advocacy organization that fights for lower taxes, less government and more freedom and is headed by former House Majority Leader Dick Armey, has stepped in with an organizer and an insurance policy to save the Cape Coral, Fla., Tea Party.
During a Sunday night phone interview with Freedom Works members Mary and Ron Rakovich, the pair told me they will hold the event dubbed “April Fool’s Tea Party at the Park,” and want to send a message to the city that the people of Cape Coral will be heard. If you are in the area, join them from 5 to 7 p.m. on April 1 at Jaycee Park, 4125 SE 20th Place (at the end of Beach Parkway off Del Prado in Cape Coral, Fla).
Oh yeah sure, ban us because there may be too many people. But they didn’t stop the fifty jillion mexicans and their enablers for their annual La Raza marches. Oh no, that was OK.

Given that the only thing that differentiates govt from any other institution in a free society is the power to coerce compliance: more govt = less liberty.

I agree with you wholeheartedly Andrew. Did our founding fathers worry about permits and police when they protested government persecution? Besides, it’s our money that funds these public spaces and without our tax dollars they wouldn’t be there so what right does the government have to tell us we can’t assemble?

How under the First Amendment to the Constitution of the United States does the Governor of Florida have that right? You have the right to free speech and peaceful assembly and under the law of the land, which is the Constitution, no state can take away our rights. Unless we let them. Lincoln said: to sin by silence, when they should protest makes cowards out of men. He loved freedom and more he loved America let me leave you with my favorite quote of his: America will never be destroyed from the outside. If we falter and lose our freedoms, it will be because we destroyed ourselves.

So, the following may be somewhat of a moot point, but I will post what I know…
I have been in contact with both Lynn Rosko (the original Cape Coral Tea Party organizer) and the Cape Coral City Manager
Terrance Stewart. I sent a protest email to Cape Coral officials, and I received a response from Mr. Stewart. I was
subsequently involved in an email discussion between Ms. Rosko and Mr. Stewart. I have never met either party, and I will let these highlights speak for themselves. You can make your own judgements.
Ms. Rosko:
They are the ones that insisted there would be 500 or more people at this local gathering which would enable them to invoke all their rules which would have included indemnifying the City with $1 million dollars of insurance, cost of Police, Fire, EMS and cleanup fee and leaving me in an untenable liability situation and significant costs.
Mr. Stewart:
The City did not insist there would be greater than 500 attendees, we merely raised the concern because of our awareness that this type of event was garnering significant press and interest nationwide and believed that interest may draw more than 500. With that knowledge it would have been totally irresponsible to Ms. Rosko and to our community to let her proceed without informing her of that concern. We even offered to post a ranger at the park entrance to count heads and stop further entrants at 499. One must ask oneself why we would do this if we were attempting to stop the event. She says that she was left in an untenable liability situation with possible significant costs. Our rules did not create the liability situation, only the event itself would have done so. As to the cost for Police, Fire and EMS, those cost would be incurred and must be borne by someone.
Ms. Rosko:
This is not true! Mr. Pohlman was adamant that there would be 500 people, bringing into play all the rules and regulations in their attempt to stop the Tea Party of “local residents” to discuss local issues! I was told by Mr. Pohlman that he would have a Park Ranger there to count the people as they came into the park and if it was over 500, basically it would be shut down! It was not offered, it was stated as a fact.
I sent the following question to Mr. Stewart:
Was Ms. Rosko required to accept liability for everyone’s actions if the group size was less than 500? To me that is the crux of the issue. Requiring that an individual accept responsibility for the actions of 499 other individuals (or be faced with paying for an insurance policy to avoid such personal liability for small crowds) seems unreasonable to me. If this was the case, I think the system is broken, because it would definitely have the effect of curtailing free speech rights. No one in their right mind would accept responsibility for other individuals, meaning that if they can’t afford to pay for insurance, there is no protest — even of 499 people.
I did not receive any further response from Mr. Stewart. You can judge for yourself what silence indicates.
What do you MEAN city officials won’t let you protest? The Constitution of the United States WILL!!! Whose country is this anyway? It’s cowardice like this that has lead us down this road to Fascism in the first place! Pick up your signs and do what good and loyal Americans are doing all over the country: Protest in the streets! Tell your “city officials” ( hope they have day jobs) to take a hike - preferably to the socialist country of their choice. I see all these leftist political groups have these sit ins get arrested and no one gets hurt, of course there are acceptions, but we as concerned individuals for our country should be willing to spend a night in jail or take a punch, for a cause so just! I call for these actions now because of where we are as a nation. The Government, as it is today, is a sick parody of what the founding fathers intended. Like a malignant cancer cell, is spreading its’ influence deeper and deeper into areas where it has no business, causing problems were there need not be.
10 to 15 years ago these actions, on our part, (those average folk who support the spirit of the tea parties) would not have been needed, but now, when the very foundations of this nation are literally on their last legs, and heavy hand of the government is trying to push us into the tightest box possible, restricting our very ability to make our own decision and provide for our own futures, Bolder actions must be taken by the common man if we are going to survive as the nation we were intended to be by the founding fathers. I fear, with all my heart, what could happen in the next 10 to 15 yrs, what action might be taken by both sides in the fight for the very soul of this America.

I remember a rally several years ago by the Hispanic Community—they had no permits, shut down major streets in Fort Myers, were parking all along Interstate 75 and cost the City of Fort Myers and Lee County thousands of dollars for the extra law enforcement that was required so they could march for their cause. The sad thing about this was the fact that they were rallying for the “illegal immigrants” in our country who really don’t have rights since they are not AMERICAN CITIZENS. The powers that be had discussed charging them a fee for their services, but did not. So, if people who are in this Country illigally can have a march to protest their cause, by gosh, I think American citizens should have the red carpet rolled out for them so they can exercise their right to freedom of speech and their right to protest!!!
